Our TERMS AND CONDITIONS inform you of Sacoplex's use of your personal information whenever it is necessary to make its services available.
This document establishes the pre-contractual information relating to contracts concluded at a distance on the web page loja.sacoplex.pt, referred to in article 4 of Decree-Law No. 24/2014 of 14 February, and all subdomains/subwebsites.

Sacoplex reserves the right to freely modify this pre-contractual information in order to adapt it to the applicable law, without the need for any prior notice.

The online sale is valid and applicable to European territory.
The User undertakes to use this website in compliance with the provisions of applicable law, refraining from using the website for activities contrary to law, morality and good manners, or rights and interests of third parties.

All content and information included at loja.sacoplex.pt and its subdomains are the property of Sacoplex and therefore the use, reproduction, copying and dissemination by other means of logos, texts, images and videos contained in that website are subject to Sacoplex’s prior authorization.
5.1 Information on Products
Sacoplex takes into account the information on the essential characteristics of the products by means of technical descriptions shared by its suppliers, of photos and videos that illustrate the products sold, in strict respect of the best standards in the market.
5.2 Information on Prices
The retail prices shown at loja.sacoplex.pt and its subdomains are indicated in Euros. VAT is included in all prices mentioned. The price without VAT is also indicated for reference in the case of a company. The shipping service costs are borne by the user and buyer and they add to the total price of the selected products. The user shall be informed of these charges before confirming their order and completing the purchase process. Sacoplex reserves the right to change prices at any time. However, Sacoplex undertakes to apply the fees and prices indicated at the time of making the purchase order.
In the event of a computer, manual, technical or other error, which causes a substantial change not foreseen by Sacoplex in the retail price, in such a way that it becomes exorbitant or manifestly derisory, the purchase order shall be considered invalid and void.
The prices and products available at loja.sacoplex.pt are only valid for purchase orders made at loja.sacoplex.pt and may not coincide with our physical shop.
6.1 Registration
To place an order you need to access loja.sacoplex.pt, and register as a user on that website, filling out the electronic form following the instructions of each step. After the registration, you can purchase your product(s).

Items available at loja.sacoplex.pt have a limited stock and may be unavailable without notice. However, because we have a wide variety of products available, it is possible to find similar items that match your needs and that have the characteristics you want.

6.4 Fees and Taxes
The retail prices shown at loja.sacoplex.pt are indicated in Euros. VAT is included in all prices. The price without VAT is also shown for reference. The user shall be informed of these charges and prices before confirming their order and completing the purchase process.
If you wish to return a product, you must comply with the applicable legislation, namely the provisions of articles 6 and 8 of Decree-Law No. 143/2001 of 26 April, as amended by Decree-Law No. 57/2008 of 26 March, by Decree-Law No. 82/2008 of 20 May and by Decree-Law No. 317/2009 of 30 October. Returns due to transport damage - If you notice any anomaly or damage caused by the transport of the article you ordered, you must notify our service line.
8.1 Right of Free Termination
The consumer has a period of 14 days from the day they acquire the physical possession of the items or the day on which they acquire the physical possession of the last item in the case of several items ordered in a single order and delivered separately, to proceed to the return of their order, and without having to indicate the reason, according to the provisions of number 1 of DL No. 24/2014, of 14 February.
It may do so provided that the article is in the same condition as it was sold, in original packaging and accompanied by all the accessories that are part of it. You can do it in two ways:
• Go to Sacoplex's physical shop, presenting the corresponding invoice and delivery slip and proof of identification (Citizen's Card).
• Contact our Customer Service Line 234 721 927 (local call) for information on shipping procedures.
Note: Never ship the item to Sacoplex without prior contact with the Customer Service Line 234 721 927 (local call).
8.2 Return Conditions in case of termination of contract:
1. Items with no signs of improper use and whose handling in no case exceeds what is usually admitted to a commercial establishment under the terms and for the purposes of number 3 of article 13, and number 2 of article 14 of Decree-Law 24/2014 of 14/02.
2. Return of the complete item, with all its components and original packaging in perfect condition.
3. Return Deadline: Up to the 14th consecutive day, from the delivery day under the provisions of number 1 of article 10 of Decree-Law 24/2014, of 14 February.
Refund: In the case of a return, the refund of the value of your purchase shall be made through bank transfer after confirmation of compliance with the return conditions described above, and Sacoplex has a period of up to 14 days to that effect.
The consumer must return the items no later than 14 (fourteen) days after the date on which they informed Sacoplex of the decision to terminate the contract, having to bear the cost of returning the items.
The following contract is excluded from the right of termination of contract and the consumer cannot freely resolve it:
- Supply of items made according to the consumer's specifications or clearly personalized;
Sacoplex is not responsible for the damages resulting from any computer viruses or any other situations of which Sacoplex is unaware and that prevent the access and correct operation of the domain loja.sacoplex.pt as well as the services available in it.
10.1 What does it mean to have an account at the Sacoplex Online shop?
The creation of an online account is an opportunity to enter into purchase and sale agreements at a distance and also consult the purchase track record.
10.2 Who is the Data Controller of the Customer’s personal data?
The Data Controller is Sacoplex - Comércio de Embalagens, Lda., with registered office at Estrada Nacional 333, No. 51, Oiã, Portugal, legal person number 506 936 716, which is also its registration number at the Oliveira do Bairro Commercial Registry Office, with a share capital of € 25,000.00, hereinafter abbreviated as Sacoplex.
10.3 What data are processed by Sacoplex?
Sacoplex processes the following personal data: name, email, tax identification number and addresses, telephone and IBAN.
10.4 Why does Sacoplex need the Customer’s personal data?
The personal data mentioned above are processed for the purposes of authentication, invoice issuance and processing of the home delivery process. IBAN is only required to process returns.
The personal data shall also be used to identify potential consumer preferences, including profiling, based on distance purchase track record. The forecast of consumer preferences and profile identification aim at the elaboration of customized marketing actions, the optimization of the product range made available online, as well as the communication of campaigns that are predictably of the client's interest, and these can be attributed and communicated automatically. Sacoplex requests the Customer’s consent to proceed with this processing.
10.5 To whom does Sacoplex transmit your personal data?
Sacoplex only transmits your personal data to the Tax Authority, to companies hired to deliver items at home, to financial entities.
10.6 How does Sacoplex communicate campaigns, offers, or benefits to the customer?
The campaigns, offers, or benefits are communicated via SMS, email, or other actions through digital platforms, and the customer is informed of how they can stop receiving them. The campaigns, offers, or benefits may also be visible, either in our physical shop or in the online shop, through loja.sacoplex.pt.
10.7 What is the conservation period of the Customer’s personal data?
Sacoplex shall delete the client’s personal data after a period of 10 years, which is the period for the conservation of documents for tax purposes. The data shall also be deleted within one month after the client expresses their intention to cancel it. In this case, Sacoplex shall only keep transaction data for tax purposes.
10.8 What are the Client’s rights and how can they exercise those rights?
As a rule, the client has the following rights in terms of personal data protection: right to access, right to rectification, right to erasure, right to restrict processing, right to portability, right to object and right not to be subject to automated individual decision-making.
The right to information, access and rectification can be exercised directly by the client on the platform. Sacoplex shall carry out a careful analysis of the requests, assessing their legitimacy, pertinence and responding in a timely manner. If necessary, the client may also file a complaint with the National Data Protection Commission (NDPC).
These general conditions and all the contracts that come to be celebrated under the same are governed by the Portuguese legislation.
